JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-06-2018 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Aurangabad Muffassil P.S. Case No. 64 of 2018 for the offences under Sections 30(a), 33 and 38 of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and the alleged recovery was made from Khalihan and as such the petitioner cannot be fastened with criminal liability on account of recovery of liquor. Considering the facts that the petitioner has no criminal antecedent and the liquor was recovered from Khalihan in plastic bag, the Court inclined to grant bail to the petitioner.
