JUSTICE SANDEEP KUMAR ORAL ORDER 11-05-2023 This application has been filed for quashing of the F.I.R. vide Saran Mahila P.S. Case No. 43 of 2021 registered for the offence under Sections 323, 379, 307, 328/34 and 498-A of the Indian Penal Code.
The supplementary affidavit filed by the petitioner is taken on record.
Learned counsel for the petitioner has submitted that the parties have entered into a compromise and therefore, this Court may quash the present F.I.R.
Sri Sanjay Kumar Singh, learned counsel for the opposite party no.2 does not dispute the fact that both the parties have entered into a compromise and he has no objection if the
Patna High Court CR. MISC. No.16681 of 2022(2) dt.11-05-2023 2/2 prosecution of the petitioner is quashed.
In view of the aforesaid submissions of the parties and in the interest of justice, this application is allowed. Accordingly, the F.I.R. vide Saran Mahila P.S. Case No. 43 of 2021 and all other consequential proceedings arising out of the aforesaid F.I.R. are hereby quashed.
The Maintenance Case No.72 of 2022 pending in the Court of Principal Judge, Family Court, Saran at Chapra is also directed to be dropped.
Let a copy of this order be communicated to the District Judge, Saran at Chapra through FAX forthwith for its compliance.
