The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 148, 149, 341, 323, 302, 120(B), 504, 506 of the Indian Penal Code. As per the prosecution case, this petitioner alongwith other F.I.R. named accused persons, armed with lathi, danda etc., abused and assaulted the informant and his father, as a result of which, father of the informant died in course of treatment.

It is submitted on behalf of petitioner that there is general and omnibus allegation. F.I.R. has been lodged against 20 named and 4-5 unknown persons, but as per post-mortem report (Annexure-2), the deceased sustained only three injuries. Petitioners have got clean antecedent.

No.16903 of 2022(2) dt.27-09-2022 2/2 However, learned A.P.P. for the State opposed the bail petition and submitted that this petitioner, who is named in the F.I.R., alongwith other co-accused persons have brutally assaulted informant and his father, as a result of which, father of informant died in course of treatment.

Considering the same, the prayer for anticipatory bail of petitioner is rejected.
