The appellant seeks regular bail in connection with Special Case No.281 of 2017 (arising out of Sri Krishna Puri P.S.Case No.94 of 2017) registered for offences punishable under Section 341, 323, 376, 313, 504 & 328 of the Indian Penal Code and Section 3(1)(x) of SC/ST (Prevention of Atrocities Act) Act. Allegation against the appellant is that he was living in relationship with the informant and during that period he also made video of his relationship and started blackmailing her. Further allegation is that he has also tried to miscarriage her pregnancy.
Submission of the learned counsel for the appellant is that now both the parties have settled the dispute and they are ready to marry and live together. The appellant is in custody for four months.
Patna High Court CR. APP (SJ) No.2716 of 2017 (3) dt.12-10-2017 2/2 Heard learned Special P.P. and the learned counsel for the informant. It is submitted on behalf of the informant that both the parties are ready for marriage, as such provisional bail may be granted to the appellant.
Having heard both sides in view of the facts and circumstances, this appeal is disposed of with direction to the learned court below to release the appellant on provisional bail for four months in connection with Special Case No.281 of 2017 (arising out of Sri Krishna Puri P.S.Case No.94 of 2017) to his own satisfaction for a period of three months, in order to enable them to perform marriage and after completion of four months, the appellant shall surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below on the basis of materials available at that time and on being satisfied with the fact that their marriage has been solemnized and they are enjoying their conjugal life, he will pass appropriate order without being prejudiced by any observation of this Court.
With the aforesaid observation, this appeal is disposed of.
