2. The petitioner apprehends his arrest in a case registered for the offence under Section 317(4) (5) of the Bhartiya Nyaya Sanhita, 2023.
3. As per the prosecution case, on 15.10.2024 at about 7.10 PM, out of two miscreants, one miscreant namely Rahul Gupta was apprehended and on search of his house, several smart phones of different companies, laptop, charger and other things were recovered. The apprehended co-accused Rahul Gupta disclosed the name of petitioner, who fled away from the spot and he further disclosed that this petitioner provided aforesaid stolen articles to him to unlock and sell the same in Nepal.

Learned counsel for the petitioner submits that no incriminating article has been recovered from the possession of this petitioner and has been made accused in this case only on the basis of confessional statement of co-accused Rahul Gupta, which has got no relevance in the eye of law. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Bairgania P.S. Case No. 260 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) anay U T
