JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-07-2018 Heard the learned counsel for the petitioner and learned counsel appearing on behalf of State. The petitioner is in custody in connection with Laukahi P.S. Case No. 250 of 2017 for the offence under Sections 20(b) ii(C) N.D.P.S. Act 198530(a), 35, 38 of the Bihar Prohibition and Excise Act.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody in connection with seizure of 16.5 Kgs. Ganja. Learned counsel submit that the petitioner is in custody since 28.10.2017. In the instant case three persons were arrested along with 16.5 Kgs. Ganja including this petitioner.
Considering the fact that the petitioner has remained in custody for nearly nine months and he has no criminal
