Petitioners apprehend their arrest in a case registered for the offence punishable under Section 420, 467, 468, 471/34 of the Indian Penal Code.

As per the prosecution case, co-accused, Ramesh Pandey and Sunil Pandey sold two Katha of land of the complainant to petitioner No.1 and 2.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. Petitioners are bonafide purchasers of the land from

Patna High Court CR. MISC. No.16255 of 2022(2) dt.27-09-2022 2/2 Ramesh Pandey and Sunil Pandey on the basis of genuine documents and no element of cheating or forgery is involved in the transaction. Moreover, the dispute is of civil nature. Petitioners have got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case and clean antecedent of the petitioners, let the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial MagistrateXVI, Gopalganj in connection with Complaint case No. 943/ 2020, subject to conditions laid down u/s 438(2) of the Cr.
