This is an application for bail in connection with Panapur P.S. Case No. 70 of 2017 registered for the offences punishable under Sections 386, 387 of the Indian Penal Code and 17 of C.L.A. Act.
Allegation against the petitioner is of demand of extortion from the informant.
Submission of learned counsel for the petitioner is that petitioner has falsely been implicated in this case on the basis of confessional statement and except that there is nothing against him and he is in custody since 8.5.2017.
Heard learned APP also, who has opposed the prayer for bail stating that the mobile from which the extortion was
Patna High Court Cr.Misc. No.39659 of 2017 (3) dt.08-09-2017 2/2 demanded has been recovered from his possession and there is confession of the petitioner also.
Having heard both sides and in view of facts and circumstances, I am not inclined to grant bail to the petitioner. However, as the petitioner is in custody for four months, learned trial court is directed to expedite the trial. With the above observation, this application is dismissed.
