JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 26-04-2024 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The present petition has been filed to renew the prayer for grant of bail to the petitioner which was earlier rejected vide order dated 03.05.2023 passed in Cr. Misc. No. 8022 of 2023.

The prosecution case as per F.I.R is that all the F.I.R named accused persons including the petitioner armed with deadly weapons came at the door of the informant and started assaulting her husband. It is

Patna High Court CR. MISC. No.23009 of 2024(3) dt.26-04-2024 2/3 further alleged that this petitioner fired upon the head of the informant's husband by means of a double barrel gun, as a result of which, he sustained gunshot injuries and died.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case due to previous enmity. The petitioner is languishing in custody since 19.07.2022. In pursuance to the direction of this Court, a report with regard to the present stage of the case has been received which has been kept at Flag-R. The report of learned Additional District & Sessions Judge, 1st, Saharsa dated 23.03.2024 suggests that trial will be concluded within eight months.

In that view of the matter, the petition is disposed off with a direction to the learned Court below to expedite the trial and conclude the same within a period of six months from today.

The petitioner will be at liberty to renew his
