JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner as well as learned APP.

The facts of the case as is evident from the written report filed by the informant, a police official is that the order of the High Court passed in Cr. Misc. No. 45344/2016 dated 19.10.2016 has been stayed vide order dated 28.10.2016 by the Hon'ble Apex Court in Special Leave to Appeal (Crl) No. 8306/2016, on account thereof, as directed, he was to intercept the accused who was seen coming from Patna Airport, accordingly, intercepted but he along with his parents and one another had gone over Fortuner Vehicle defying his direction. It has also been alleged that during midst thereof, the accused persons projected themselves violently.

No.40124 of 2017 (2) dt.21-09-2017 From the annexure having been tagged with the written report, a communiqué sent by the Standing Counsel, it is evident that S.S.P., Gaya was requested to file a petition for cancellation of bail which was filed on 28.10.2016 at 4.30 PM having an order from the P.O. to be put up on the date fixed. Learned APP has submitted that petitioner has been convicted in the main trial.

Be that as it may, considering the merit of the case, petitioner, ROCKEY YADAV @ RAKESH RANJAN YADAV @ ROCKEY is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Patna in Hawai Adda PS Case No. 174 of 2016.
