JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 11-06-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner, in the present case, is seeking regular bail in connection with Gandhi Maidan P.S. Case No.155 of 2018, registered for offences alleged under Section 27 of the N.D.P.S. Act.

Learned counsel for the petitioner submits that five Purias each containing 10 grams of Ganja have been allegedly recovered from the possession of the petitioner which according to the F.I.R. he had owned for his own consumption. It is further submitted that the petitioner has got no criminal antecedent and the offence alleged against the petitioner would entail maximum punishment of six months.

Patna High Court Cr.Misc. No.33844 of 2018 (2) dt.11-06-2018 Learned APP for the State is present.

In the facts and circumstances considering that the petitioner is in custody since 23.04.2018 and altogether 50 grams of Ganja is said to have been recovered from his possession, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judgecum-Special Judge, N.D.P.S. Act, Patna in connection with Gandhi Maidan P.S. Case No.155 of 2018 (N.D.P.S.) Special Case No.39/18, subject to the conditions U/S 437(3) Cr.P.C. (Rajeev Ranjan Prasad, J) Arvind/- U T
