The petitioner is in custody in connection with Makhdumpur (Tehta O.P.) P.S. Case No. 113 of 2018 registered under Sections 366 (A)/34 of the IPC.

Learned counsel for the petitioner has drawn attention of the Court to Annexure-2 to indicate that the age of the victim is 19 years. Referring to the statement under Section 164 Cr.P.C. learned counsel submits that the victim has categorically stated that she has joined the wedlock with this petitioner on her own volition at Hilsa.

In view of the statements of the victim under Section 164 Cr.P.C., learned counsel for the petitioner submits that the petitioner and the victim have joined wedlock and they are

Patna High Court Cr.Misc. No.33011 of 2018(2) dt.04-06-2018 2/2 residing as husband and wife and as such the petitioner deserves bail.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in connection with Makhdumpur (Tehta O.P.) P.S. Case No. 113 of 2018.
