The petitioner is in custody in connection with Sourbazar P.S. Case No. 611 of 2017 for the offence under Sections 365, 302, 201, 120(B) and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has been implicated in this case only on suspicion. The FIR was lodged against unknown.

It appears that similarly circumstanced co-accused Shekhar Kumar Bharti has been granted bail vide order dated 11.5.2018 in Cr. Misc. No. 22434 of 2018.

Considering the fact that the petitioner has no criminal antecedent nor he was named in the FIR and similarly circumstanced co-accused has been granted bail by this Court in

Patna High Court Cr.Misc. No.33037 of 2018(2) dt.04-06-2018 2/2 Cr. Misc. No. 22434 of 2018, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Sourbazar P.S.
