JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-03-2017 In view of the minutes of Hon'ble the Acting Chief Justice dated 21.12.2016, the matter has been listed before this court.

Heard learned counsels for the petitioner, informant and the State.

The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323 and 498A/34 of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act.

The petitioner and the informant are present. The basic accusation is of torture for non fulfillment of dowry demands.

Patna High Court Cr.Misc. No.17733 of 2016 (11) dt.28-03-2017 2/2 It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the informant having no issue. It is further submitted that the issue has been reconciled and both the petitioner and the informant are residing together. Learned counsel for the informant does not controvert the contention of learned counsel for the petitioner and in the circumstances, is not opposing the prayer of the petitioner for anticipatory bail.

Considering the present stand of the parties, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Purnea in connection with Mahila (Purnea) P.S. Case No.60 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
