This application, for grant of anticipatory bail, arises out of Nasriganj P.S. Case No. 234 of 2016 disclosing offences under Sections 147, 148, 149, 323, 379, 307, 504, 5066 and 354 of the Indian Penal Code.

Learned counsel for the petitioners has submitted that it is evident from the FIR that the occurrence if any had taken place because of petty dispute between the parties over possession of the land. Making false allegation of snatching golden ear rings (worth Rs. 6,000/-) has become very common in such scuffle. The accused persons belong to same family and informant and the accused persons are

Patna High Court Cr.Misc. No.46338 of 2017 (2) dt.22-09-2017 2/2 agnates. It is further submitted that it is difficult to say that an offence under Section 307 IPC is made out, on the basis of what has been alleged in the F.I.R..

Considering the submission, as above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Nasriganj P.S. Case No. 234 of 2016 subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
