JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 27-06-2018 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. The petitioner wants to renew her prayer of prearrest bail which was earlier rejected vide order dated 19.09.2017 passed in Cr. Misc. No. 44001 of 2017, on the ground that similarly situated co-accused Renu Devi has been allowed pre-arrest bail vide Cr. Misc. No. 42070 of 2017 by order dated 21.12.2017. There is allegation that the petitioner and Renu Devi both assaulted the informant with sharp edged weapon causing injury on his head but only one incised wound over left forehead has been found, no second injury has been found on the forehead of the informant caused by sharp edged weapon and, as such, the petitioner also deserves sympathetic consideration.

Patna High Court Cr.Misc. No.33212 of 2018(2) dt.27-06-2018 2/2 Learned A.P.P. duly assisted by the learned counsel for the informant opposes the prayer of pre-arrest bail by submitting that one incised wound has been found over left forehead of the informant and there is allegation against the petitioner also for assaulting with sharp edged weapon. In view of the above facts and circumstances as stated above, considering that similarly situated co-accused Renu Devi has been allowed pre-arrest bail by another coordinate bench of this court and, as such, the petitioner above named, in the event of her arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bond of Rs.

10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada, in connection with Nawada Town P.S. Case No. 423 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.)
