JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier the prayer for bail of the petitioner was rejected by this court vide order dated 07.05.2015 passed in Cr. Misc. No. 12543 of 2015 but submission on behalf of the petitioner is that the complainant as well as petitioner are ready to resolve their dispute and information regarding the aforesaid fact was given to the Sessions Judge, Gaya in A.B. P. No. 15 of 2016 but the prayer for anticipatory bail of the petitioner was rejected by learned Sessions Judge, Gaya.
In view of the aforesaid submission, this petition
Patna High Court Cr.Misc. No.19981 of 2016 (2) dt.10-08-2016 2/2 stands disposed of with observation that if the petitioner files fresh anticipatory bail petition before the learned Sessions Judge, Gaya and makes prayer to resolve the dispute with the complainant, the learned Sessions Judge, Gaya, after due and proper hearing of the petitioner and complainant, shall pass appropriate order on anticipatory prayer of the petitioner, without being prejudiced by this order as well as previous rejection order of this court.
