The petitioners seek bail in a case registered under Sections 147, 148, 149, 341, 323, 332, 333, 337, 338, 353, 186, 307, 504, 506, 427, 386 of the Indian Penal Code, Sections 3⁄4 of Explosive Substance Act, Section 3⁄4 of Prevention of Damage to Public Property Act, Section 27 of the Arms Act and Section 67

Patna High Court CR. MISC. No.14564 of 2020(2) dt.02-03-2020 2/2 of the Information Technology Act.

Allegation is that the accused persons were throwing stones upon the police. They also damaged the public property. It has been submitted on behalf of the petitioners that the petitioners are in custody since 22.12.2019 and have got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are members of unlawful assembly. General and omnibus allegation has been made. No specific overt act is alleged against the petitioners. Other coaccused has been granted bail vide Cr.Misc.No.11940 of 2020. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Town P.S. case No.487 of 2019.
