JUSTICE ASHUTOSH KUMAR ORAL ORDER 20-07-2018 The petitioners seek bail in anticipation of their arrest in connection with Durgawati P.S. Case No. 125 of 2018, dated 09.04.2018, instituted for the offences punishable under Sections 341, 323, 354 and 509/34 of the Indian Penal Code.
Patna High Court Cr.Misc. No.37090 of 2018 (3) dt.20-07-2018 2/2 The petitioners are said to have assaulted the son of the informant and others as well, leading to injuries on their persons. Though, the genesis of the occurrence is assault on the son of the informant and on protest, the other persons also were assaulted, but the fact of the matter is that there is a dispute between the two sides with respect to the fishing rights in a pond.
There is a counter version of the occurrence as well. No serious injury is reported to have been caused to anyone of the injured persons. In fact, petitioner No. 1 also has been seriously injured in the occurrence. Regard being had to the aforesaid facts and the manner of assault, let the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, be released on bail on their furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhabua in connection with Durgawati P.S. Case No. 125 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
