2. The petitioner seeks regular bail in connection with Azimabad P.S. Case No.71 of 2023, registered for the offences punishable under Section 393 of the Indian Penal Code.
3. As per the prosecution case, when the informant was returning to his home by his motorcycle then three unknown persons on bike who were carrying iron chain in their hands came there and started assaulting and abusing him and tried to rob his valuable and cash. The police arrested them including the petitioner.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this

He further submits that there is no independent eyewitness in the seizure list and nothing has been recovered from the conscious possession of the petitioner. He also submits that similarly situated co-accused, namely, Manoranjan Kumar @ Chhotu Singh has already been granted regular bail by this Court vide order dated 16.01.2024 passed in Cr. Misc. No. 86098 of 2023. He further submits that petitioner has no criminal antecedent and he is in jail custody since 21.08.2023.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.
6. Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Ara in connection with Azimabad P.S. Case No.71 of 2023.
