Case No.19/2014.

Apprehending his arrest, the petitioner filed A.B.P. No.295/2014 in the court of learned Sessions Judge, Purnea. The same was dismissed on 17.6.2014. Hence, this application for anticipatory bail under Section-438 of Cr.P.C. Heard learned counsel for the petitioner and learned A.P.P. for the State.

Most of the arguments advanced by the learned counsel for the petitioner are on merits. The truth or otherwise of the allegation against the petitioner can be dealt with only in the trial.

Patna High Court Cr.Misc. No.29769 of 2014 (3) dt.25-06-2015 2/2 Having regard to the seriousness of the offence alleged against the petitioner, this Court is not inclined to grant anticipatory bail. Application is dismissed.

If he is so advised, the petitioner can surrender before the court below and move an application for regular bail. It is directed that in case the petitioner surrenders before the trial court and moves an application for regular bail, the same shall be dealt with expeditiously and not later than three days from the date of filing of such application.
