JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Section 498A, 323, 379, 34 of the Indian Penal Code. There is a complaint case filed by the complainant. Allegation against the petitioner and other in-laws is of torture the complainant due to non fulfilment of demand of dowry. Submission of the learned counsel for the petitioner is that he is in custody for about four months. The conduct of the wife is not good. The marriage has been solemnized 24 years prior. The petitioner is the husband of the complainant. Heard learned A.P.P. also.
Having considered the facts and circumstances of the
Patna High Court Cr.Misc. No.40076 of 2017 (2) dt.24-08-2017 2/2 case this application is disposed of with a direction to the trial court to conclude the trial within a period of nine months and if the trial is not concluded within nine months, however, in the meantime, the above named petitioner, shall be released on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-7, Saran, Chapra in connection with Complaint Case No. 2966 of 2006 corresponding to Tr. No. 962 of 2017, subject to the condition that one of the bailors should be a local person having sufficient immovable properties within the jurisdiction of court concerned and he shall co-operate in disposal of trial, otherwise his bail bonds shall be cancelled.
