JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 19-07-2024 Both these applications arise out of the same case i.e. Piprakothi P.S. Case No. 245 of 2023 and hence, the same are being disposed of by this common order.

2. Heard learned counsel for the petitioners and learned APP for the State.

3. The petitioners seek regular bail in connection with Piprakothi P.S. Case No. 245 of 2023 registered for the offence punishable under Sections-147, 148, 149, 341, 323, 324, 325, 379,

Patna High Court CR. MISC. No.17286 of 2024(3) dt.19-07-2024 2/2 307, 504, 506 of the Indian Penal Code.

3. Allegedly, on the date of occurrence, the accused persons including the petitioners having armed with weapons came at the shop of the informant and the petitioners alongwith others is said to have given sword blow on the head of informant and his brother as a result of which, they sustained bleeding injury.

4. Learned counsel for the petitioners has submitted that there is case and counter case between the parties and members of defence side have also suffered injuries. Both the parties are on litigating terms. A title suit is also pending between the parties.

5. Learned APP has opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Piprakothi P.S. Case No. 245 of 2023 with condition that the petitioners shall cooperate with the trial of the case and make themselves available as and when required by the court.
