In this case, the petitioner is seeking regular bail in connection with Rajgir P.S. Case No.261 of 2019 registered for offence punishable under section 147, 149, 302 and 120 (B) of the Indian Penal Code.

An FIR has been lodged making allegation that on 13.07.2019 at about 5.00 P.M., Sunil Rajbanshi, the elder son of the informant along with Pintu Rajbanshi went to village Ramanand Nagar to pay the labourers to work on Bhatha where the barat of daughter of Gore Lal Manhi came in which Dije was being played. Some dispute arose in the matter of payment whereupon the present petitioner along with other accused persons have assaulted and killed the victim and threw his body

The learned counsel for the petitioner submits that there is no direct allegation made against the petitioner and she has wrongly been framed in the present case, hardly she could cooperate in assaulting the victim. The petitioner being a lady is in jail custody since 03.10.2019 Looking to the facts and circumstance of the case, the petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Rajgir P.S. Case No.261 of 2019, subject to the condition that one of the bailors of the petitioner shall be a close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make herself available as and when required by the court. In case of failure, the prosecution will have liberty to file an application before for cancellation of her bail bond.
