Petitioner apprehends his arrest in a case under section 420 of the Indian Penal Code.
The gist of the allegation is that although the petitioner agreed to sell his land to opposite party no. 2 and received part of the consideration money but later on refused to sell his land to complainant.
Learned counsel for the petitioner submits that there is not a cheat of paper to show that petitioner has received any money for execution of sale deed.
On the face of it, it appears that the dispute is of civil nature.
Patna High Court Cr.Misc. No.29901 of 2014 (3) dt.20-03-2015 Considering the facts, the petitioner is directed to surrender the court below within a period of four weeks from the date of receipt/production of a copy of this order, the court below shall enlarge the petitioner on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri M.Kumar, J.M. Ist. Class, Supaul in connection with Complaint Case No. 764 ( C ) /2012, subject to the conditions laid down under sections 438 (2) Cr.P.C.
