The petitioner seeks regular bail in connection with Motipur P.S. Case No. 894 of 2018 for the offences punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-b), a, 26, 35 of the Arms Act.

The allegation is regarding recovery of one country made pistol and three live cartridges from possession of the petitioner when he was apprehended by the police. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 10.10.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to direct for release of the

No.15359 of 2019(2) dt.12-03-2019 2/2 petitioner immediately upon completion of six months of his custody i.e. w.e.f. 10.10.2018 subject to such condition as may be imposed by the learned court of Sub-Divisional Judicial Magistrate, Muzaffarpur in connection with Motipur P.S. Case No. 894 of 2018.

The petition stands disposed of with the aforesaid directions.
