Heard learned counsel for the petitioner and the State. Learned counsel for the petitioner has made a prayer for extension of time to appear before the court below. From perusal of the record, it appears that anticipatory bail petition of the petitioner was allowed on 02.07.2018, vide Cr. Misc. No.15540 of 2018 and the petitioner was directed to surrender before the court below within a period of eight weeks

Patna High Court CR. MISC. No.22256 of 2021(2) dt.25-10-2021 2/2 from the date of receipt of copy of the order. The petitioner could not surrender before the court below. Accordingly, he filed a petition being Cr. Misc. No.72150 of 2018 for extension of time which was rejected by this Court on 12.12.2018. While rejecting the said petition being Cr. Misc. No.72150 of 2018, this Court had ordered the court below to take necessary steps in accordance with law to proceed in the case. Again the petitioner, after a lapse of two years filed second petition for extension of time.

I see no reason to deviate from the earlier order of this Court dated 12.12.2018. Accordingly, this application is rejected.

Office shall ensure that all defects are removed and compliance with the notices of this Court are made by the petitioner within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
