The petitioner apprehends his arrest in Magadh Medical P.S. Case No. 67/2015, registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code. The informant alleged that his son Ajay Yadav was living in his sasural, but the petitioner and other accused persons killed him and threw his dead body.
Learned counsel for the petitioner submits that the informant only suspected the hands of the petitioner and there is no eye-witness of the occurrence. The dead body of the deceased was found. Vijay Yadav informed the informant and others. Vijay Yadav named the petitioner only on suspicion. Petitioner is not the
Patna High Court Cr.Misc. No.20556 of 2016 (4) dt.27-07-2016 2/2 family member of Munni Devi wife of the deceased. It appears from the case diary that informant as well as other witnesses stated that the petitioner and others killed Ajay Yadav. Anticipatory bail petition of Lila Yadav was dismissed as withdrawn vide order dated 21.04.2016 passed in Cr. Misc. 12805/2016. The case of petitioner stands on the same footing. Munni Devi and others have been granted bail. Considering the facts aforesaid and the nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
