Petitioner seeks bail in a case registered under Sections 341, 323, 324, 307, 379, 504, 506/34 of Indian Penal Code.

On the written report submitted by the informant regarding assault on his mother, the instant case has been instituted. The specific allegation of giving threats and of giving the farsa blow on the head of the mother is attributed to one Gajendra Thakur. It is submitted on behalf of the petitioner that he along with all other family members has been implicated in this case without any specific allegation of assault attributed to them. It is further submitted that the informant and the petitioner are

Patna High Court Cr.Misc. No.37129 of 2017 (2) dt.10-08-2017 2/2 Gotiyas and the instant case arises out of some family dispute. He has placed on record the injury report which suggests that there is only one incised wound caused by sharp cutting weapon which corroborates the allegation of assault by Ganendra Thakur only. Though there is one another case prior to the instant case lodged against the instant petitioner, it is submitted that he is on bail in the said case.

Considering the aforesaid submissions, petitioner's prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in Bairgania Police Station Case No 145 of 2015.
