The petitioner has been in custody since 03.09.2017 in connection with Khagaria (Gangaur) P.S. Case No. 517 of 2010 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that admittedly the informant is not the eye-witness and he has given the name of the petitioner only on hear-say of other co-villagers. It is further submitted that the trial was being taken up and the informant failed to support his own prosecution story. Considering the period of custody of the petitioner and that he has no criminal antecedent, let the petitioner above named,

Patna High Court Cr.Misc. No.36427 of 2018 (3) dt.13-07-2018 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Khagaria, in connection with Khagaria (Gangaur) P.S.
