Heard learned counsel for the petitioner and learned APP for the State.
The petitioner has preferred this application for grant of regular bail in a case registered under sections 341, 323, 324, 307, 504, 506 and 379 read with 34 of the Indian Penal Code. As per the prosecution case, allegation against the petitioner is of abusing and assaulting on the head of the informant with Garasa causing cut injuries. Co-accued Pankaj Yadav also assaulted the son of the informant with Lathi. Informant's wife and daughter were assaulted on their heads. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. Nothing
Patna High Court CR. MISC. No.16662 of 2022(3) dt.28-07-2022 2/2 has been recovered from the conscious possession of the petitioner. Learned counsel has further submitted that the petitioner and the informant are full brother. There is land dispute between the parties. Learned counsel further submitted that the impugned order suggests that injury is simple in nature. The petitioner is accused in two other criminal cases as stated at para 3 of the bail petition. The petitioner is in custody since 21.12.2021.
Learned A.P.P. for the State has opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. III, Saharsa, in connection with Basnahi P.S. Case No. 76 of 2021.
The application stands allowed.
