JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-06-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 24.07.2017 passed in Cr. Misc. No. 30641 of 2017 with an observation to conclude the trial within a period of nine months.

Submission of learned counsel for the petitioner is that nine months has already expired and uptill now charge has not been framed. Further submission is that the co-accused who has been named in the FIR has been granted bail by the co-ordinate Bench of this Court vide order dated 09.11.2017 passed in Cr. Misc. No. 51893 of 2017 and the petitioner is in custody for more than one year and only on the basis of confessional statement petitioner's name transpired in this case.

No.33275 of 2018 (2) dt.22-06-2018 2/2 Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional District Judge-IV, Kaimur at Bhabua, in connection with Sessions Trial No. 374 of 2017/368 of 2017 arising out of Chainpur P.S. Case No. 03 of 2017, on the condition that one of the bailors shall be a local person having sufficient immovable property within the jurisdiction of the court concerned and further condition that the petitioner shall co-operate in disposal of the trial.
