IN THE HIGH COURT OF JUDICATURE AT PATNA
Criminal Miscellaneous No.23685 of 2015 ======================================================
1. Subhash Chandra Deo son of Late Baidaynath Deo Resident of village Bihra, Police Station- Bihra, District- Saharsa. .... .... Petitioner/s
Versus
1. The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :
For the Petitioner/s : Mr. Dinesh Maharaj For the Opposite Party/s : Mr. Anuradha Singh(App) ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 20-05-2015 Heard both sides.
The petitioner was granted anticipatory bail vide order dated 26.3.2015 passed in Cr.Misc.No.40543 of 2014 with a condition that the petitioner shall deposit Rs. 1,00,000/- within one month and rest within three months.
It appears that the petitioner did not surrender in the court below within four weeks from the date of the order and after two months the petition for extending the period of surrender is filed.
It is submitted that the petitioner filed this petition for extension of time on the ground that he was suffering from paralytic attack. But it appears from perusal of the prescriptions that before passing of the order dated 26.3.2015, the petitioner was ill but this fact was not brought to the notice of the court. The petitioner concealed the fact from the court. Considering the facts, I am not inclined to extend the period to surrender and accordingly this application is dismissed.
