JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 147,148,149,323,307 and 379 of the Indian Penal Code and section 27 of the Arms Act.
It is alleged by the informant that he went to submit tender papers in PWD Circle Office then the FIR named co accused Bablu Singh snatched tender papers, gold chain, rupees twenty thousand and gave life threatening. The accused persons made indiscriminate firing.
It is submitted by learned counsel for the petitioner that the case was instituted in 2003 and investigation is still pending. Considering the fact that investigation is still pending
Patna High Court Cr.Misc. No.25065 of 2015 (2) dt.30-06-2015 2/2 and the specific accusation is not levelled against the petitioner, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Saharsa Sadar P.S. Case No. 188 of 2003 pending in the court of learned C.J.M., Saharsa. This application is disposed of with the aforesaid observation/direction.
