The petitioner was granted provisional bail on the ground that he has to attend the Shradh ceremony of his mother for a period of two months vide order dated 11.06.2020 and he was directed to surrender before the court below after expiry of period of provisional bail.
After availing the benefit of provisional bail, the petitioner has not surrendered before the court below and on one pretext or the other, adjournment was sought in the present case. The report of the court below indicates that the petitioner has not surrendered after expiry of two months and therefore his bail bonds were cancelled on 23.01.2021 and Nonbailable Warrant was issued.
Patna High Court CR. MISC. No.17178 of 2020(4) dt.10-02-2021 2/2 The earlier counsel, who represented the petitioner, submits that the client has already taken "No Objection Certificate".
In the circumstances, the Court is constrained to dismiss the bail application. Accordingly, the bail application is dismissed.
The Senior Superintendent of Police, Gaya is directed to take recourse of all coercive measures available to ensure arrest of the petitioner at the earliest.
