JUSTICE SUDHIR SINGH ORAL ORDER 13-07-2015 The petitioners are apprehending their arrest in connection with Pirpainty P.S. Case No. 35 of 2015 for the offences instituted under Sections 147, 149, 341, 323, 307, 379, 504 and 506 of the I.P.C.
Heard learned counsel for the petitioners and learned counsel for the State.
The prosecution story, in brief, is that on 07.02.2015 at
Patna High Court Cr.Misc. No.24247 of 2015 (2) dt.13-07-2015 2/2 about 6.30 P.M., all the F.I.R. named accused persons armed with iron rod came, abused and assaulted the informant and others. It is further alleged that some cash were also taken away by them. It has been submitted on behalf of the petitioners that the general and omnibus allegation has been made against the petitioners. There is no specific allegation against the petitioners. It is further submitted that the petitioners have falsely been implicated in the present case. It has further been submitted that there is no injury report on the record.
On behalf of the State it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of four weeks from today in connection with Pirpanti P.S. Case No. 35 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhagalpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
