JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-06-2018 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Chandi P.S. Case No. 96 of 2018, for the offences under Sections 420, 120B, 272, 273 IPC and Sections 30 (a), 38 and 41 of the Bihar Prohibition and Excise Act,2016.

Learned counsel for the petitioner submits that nothing was recovered from the conscious possession of the petitioner. The petitioner was never made accused for offence under the Excise and Prohibition Act. Co-accused Nitish Kumar has been granted bail by this Court.

Considering the aforesaid, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount
