JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-06-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State as also the learned counsel for the informant. The petitioners apprehend their arrest in connection with Mehsi P.S. Case No.210 of 2018 registered under Sections 323, 324, 326, 307, 341, 354(B) and 504/34 of the Indian Penal Code. The accusation is that due to cattle dispute, the petitioners along with Md. Khatab came near the informant Farjana Khatoon and started to abuse. When the informant made protest, they laid the informant on the ground and caused assault to her. When the husband of the informant rushed to save the informant, the petitioners caught hold of the informant and her husband. In the meantime, Md. Khatab gave the knife blow at the stomach of the husband of the informant causing blood oozing injury. On the alarm

Learned counsel for the petitioners submits that, in fact, in course of the occurrence, the injury was caused to the husband of the informant by Md. Khatab but the petitioners have also been implicated in this case with false allegation of catching the informant and her husband. The petitioners have no criminal antecedents. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, District-East Champaran, in connection with Mehsi P.S. Case No.210 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
