The petitioners seek bail in anticipation of their arrest in connection with Kudra P.S. Case No. 103 of 2018 dated 26.03.2018 instituted for the offences under Sections 323, 324, 307, 504, 506/34 of the Indian Penal Code and 27 of the Arms Act.
While one government Amin had come for measurement of land, an occurrence is said to have taken place in which the petitioner no. 1 is alleged to have fired at the informant, injuring him on his arm. The petitioner no. 2 is also said to have fired, but the firing resorted by him did not hit anybody.
Learned counsel for the petitioners has submitted that the petitioners are agnates of the
Patna High Court Cr.Misc. No.34159 of 2018(3) dt.19-07-2018 2/2 informant and the injuries suffered by the informant was opined to have been caused by the hard and blunt substance. The injuries have also been stated are simple in nature as it is an abrasion of the size of 1⁄4 inch. Considering the facts that the petitioners are agnates of the informant and do not have any criminal antecedent, they are directed are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Kudra P.S. Case No. 103 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C. (Ashutosh Kumar, J) skm/- U T
