2. Since both these cases arise out of the same P.S. they are being taken up together and disposed of by this common order.
3. The petitioners apprehend their arrest in a case
Patna High Court CR. MISC. No.15770 of 2025(4) dt.03-07-2025 2/3 registered for the offence punishable under Sections 80, 123 and 3(5) of the B.N.S..
4. As per prosecution case, marriage of sister of informant was solemnized with petitioner Murari Paswan in the year 2021. It is alleged that on 31.08.2024, all the accused persons named in the F.I.R., including these petitioners, after torturing, left the sister of informant in unconscious condition at her paternal house and fled away. Thereafter, informant's sister was taken to D.M.C.H. for treatment where she was declared dead.
5. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. Informant is not an eye witness of the occurrence and only suspicion has been raised against these petitioners. Deceased died in hospital while she was under treatment. Petitioners claim clean antecedents.
6. On the other hand, learned A.P.Ps. for the State have vehemently opposed the prayer for grant of anticipatory bail to the petitioners and submitted that petitioners are named in the F.I.R. with specific accusation that they, along with other accused persons named in the F.I.R., committed torture and thereafter, brought the deceased in unconscious condition to her
Patna High Court CR. MISC. No.15770 of 2025(4) dt.03-07-2025 3/3 Maika and left her. The deceased died unnatural death within seven years of marriage.
7. Considering the facts and circumstances of the case and specific and direct nature of accusation, the prayer for grant of anticipatory bail to these petitioners is rejected. (Prabhat Kumar Singh, J) shashank/- U T
