The petitioners seek bail in a case registered under Sections 302/34 of the Indian Penal Code.
The prosecution case in brief is that in the night, some unknown persons committed murder of informant's father by blowing with sharp cutting weapon.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 23-08-2019. Charge sheet has already been submitted. The petitioners are
Patna High Court CR. MISC. No.15597 of 2020(2) dt.06-03-2020 2/2 not named in the FIR. Their name has transpired in this case on the basis of confessional statement of co-accused. There is no circumstantial evidence to suggest the participation of the petitioners in the present case.
On behalf of the State, it is submitted that the petitioners are not named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, the petitioners named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-III, Danapur, Patna in connection with Rani Talab P.S.
