JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 354,363 and 365/34 of the Indian Penal Code and section 10 of Protection of Children from Sexual Offences Act.
It is alleged that the petitioner who was driving motorcycle and the co accused Lal Mohammad being pillion rider tried to outrage the modesty of the informant and tried to abduct her but in the meantime the sister in law (bhabhi) of the informant and co villagers arrived then Lal Mohammad was caught on the spot.
It is submitted by the learned counsel for the petitioner that even assuming the accusation, the overt act has only been alleged
Patna High Court Cr.Misc. No.23963 of 2015 (2) dt.09-07-2015 2/2 against co accused Lal Mohammad and there is no specific accusation against the petitioner.
The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Barari P.S. Case No. 51 of 2015 pending in the court of learned ADJ- I cum Special Judge, Katihar This application is disposed of with the aforesaid observation/direction.
