Admittedly, the major part of the amount which is due to the petitioner, which had been incurred on the construction of a building, has been paid and the dispute only remains with respect to an amount of Rs. 11,505/-. The counter affidavit which has been filed on behalf of respondent Nos. 1 to 4 indicates that there are some interpolations in the measurement book and those interpolations have not been counter-signed by the concerned authority.
Patna High Court CWJC No.21139 of 2013 dt.20-05-2019 2/2 Thus, it has been doubted whether such amount of Rs. 11,505/- is payable to the petitioner or not. Under the aforesaid circumstances, this Court can only direct the petitioner to make a representation before the District Magistrate, Vaishali at Hajipur (respondent No. 2), who shall look at the facts and on going through the reply of the petitioner, pass orders in accordance with law. If such an application is filed within a period of four weeks from today, the same shall be disposed off within a period of four weeks thereafter. If the claim of the petitioner is found to be tenable, necessary order shall be passed for payment of the petitioner.
With the aforesaid observation/direction, the writ petition stands disposed off.
