The petitioner seeks regular bail in Aurangabad (T) P.S. Case No.147 of 2017 for the offence under Section 25(1-b)a, 26 of Arms Act and 17 of C.L.A. Act.
Allegation as per the F.I.R. against petitioner is of recovery of one red colour Maowadi Parcha, two live cartridges, two mobile sets and one purse contained Rs.2200/- from the possession of the petitioner in course of vehicle checking. Submission of the learned counsel for the Petitioner is that he has been falsely implicated in this case. His name has transpired on the basis of confessional statement of co-accused. He is in custody for three months. Though his name has come in
Patna High Court Cr.Misc. No.39149 of 2017 (2) dt.21-08-2017 2/2 four other cases.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as state above, and considering the criminal antecedent of the petitioner, I am not inclined to enlarge the petitioner on bail. His prayer for bail is rejected. However, he may renew his prayer for bail after framing of charge.
