JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-09-2024 It is submitted by the learned counsel for the opposite parties that in compliance of the order of this Court dated 28.9.2022, passed in CWJC No. 8340 of 2021, the Halka Karamchari, Nagar Panchayat, Mahua, had conducted a spot enquiry and it has been found that only during the occasion of Durga Puja celebrations, pandal is built and after the Puja is over, the same is removed, however, no other encroachment is in existence.

At this juncture, the Ld. Counsel for the petitioner submits that the way to the house of the petitioner is obstructed by construction of Pandal, hence appropriate directions be issued to the Respondents.

In response, it is submitted by the learned counsel for the opposite parties that the Collector, Vaishali and the Officer-inCharge, Mahua Police Station, District-Vaishali, shall ensure that the ingress and engress to the house of the petitioner is not obstructed by the pandal constructed during the occasion of Durga Puja.

The learned counsel for the petitioner submits that if it be so, then the present petition be disposed off. 5.

Accordingly, the present contempt petition stands disposed off.
