The petitioner seeks bail in Bariyarpur P.S. Case No.174 of 2019 registered under Section 394 of the Indian Penal Code. Later on, Sections 395, 397, 412 of the Indian Penal Code was added.

The informant named four persons, namely, Suraj, Ashish, Praful and Sintu and alleged that while he was going to his relative's village after boarding down from the train, the accused persons looted away different articles from his possession and from possession of other passengers. The learned counsel for the petitioner submits that petitioner is not named in the F.I.R. The name of the petitioner surfaced in the case in the confessional statement of Ashish. The petitioner was apprehended on 05.01.2020 and since then he is

Patna High Court CR. MISC. No.16454 of 2020(2) dt.03-06-2020 2/2 in jail but he has not been put on T.I.P. Save and except the confession of the co-accused, no tangible material has been collected from the petitioner.

Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 2nd, Munger in connection with Bariyarpur P.S. Case No.174 of 2019.
