Mr. PRANAV KUMAR ====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 21-09-2017 I have heard learned counsel for the petitioners and the State.
The petitioners seek bail in a case registered for offences punishable under sections 30 (a), 32(2), 35(c) of the Bihar Prohibition and Excise Act, 2016 and 182 of Motor Vehile Act.
It is contended that, as per allegation, 1436 litres 625 Ml. of foreign liquor were recovered from a truck. It is further contended that petitioner no. 1 is driver and petitioner no. 2 is cleaner of the truck. It is urged that that the real persons who were involved for transport of the foreign liquor have already been granted bail by the court below as per statement made in paragraph no. 7. Patna High Court Cr.Misc. No.46347 of 2017(2) dt.21-09-2017 2/2 antecedents and are in custody since 11.7.2017. Having regard to the facts and circumstances of the case, the above named petitioners are directed to be released on bail on their furnishing bail bond of Rs. 10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge IV - cum - Special Judge, Darbhanga in connection with Manigachhi P.S. Case No. 153 of 2017 cum G.O. Case No. 1251 of 2017 with further conditions that one of the bailors of the petitioners must be the resident of State of Bihar.
If the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
