JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-05-2019 This is an application for grant of anticipatory bail in connection with Dandkhora P.S. Case No. 80 of 2018, disclosing offences under Sections 302, 201, 120(B)/34 of the Indian Penal Code.
Prosecution case in short is that the deceased had love affair with one Seema Devi, but after marriage there was quarrel between the deceased and his wife and in-laws and thereafter, the dead-body of the deceased found hanging in a tree and there were some injuries on the person of the deceased and therefore the informant suspected that hand of the petitioner and others in killing the deceased.
Submission of learned counsel for the petitioner is that except suspicion, there is absolutely nothing against the
Patna High Court CR. MISC. No.15340 of 2019(3) dt.02-05-2019 2/2 petitioner and there is no material collected during the investigation against the petitioner and he has no criminal antecedent.
Heard learned A.P.P. also, who opposed the prayer for anticipatory bail of the petitioner stating that the petitioner is the Sarhu of the deceased and he was not happy with relation of the petitioner and his wife and due to that he along with others have killed the deceased.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Katihar, in connection with Dandkhora P.S. Case No. 80 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
