Petitioners seek bail in a case registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Sections 30(a) and 36 of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of liquor from a pick-up van. Petitioner was there at the time of recovery in the said vehicle. Petitioner is in custody since 31.12.2020. Petitioner has stated on oath that he has got no criminal antecedent. Considering the facts aforesaid and completion of investigation, let the petitioners, above named, be released on

Patna High Court CR. MISC. No.26278 of 2021(2) dt.20-09-2021 2/2 bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Ahiyapur Police Station Case No. 990 of 2020, subject to the following conditions:- (a) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioners.

(b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.
