Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner has preferred this application for grant of regular bail in connection with Sanjhauli P.S. Case No. 169 of 2022 dated 23.9.2022 registered for the offences punishable u/s 394 and 302 of the Indian Penal Code and Section 27 of the Arms Act.
As per the prosecution case, some unknown miscreants boarded on a motorcycle and shot the informant's
Patna High Court CR. MISC. No.16921 of 2023(2) dt.11-05-2023 2/3 brother dead and took away Rs. 83,000/-, tab and documents from the dicky of the motorcycle.
Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion. The petitioner is not named in the FIR. The name of the petitioner has sprung up in the confessional statement of co-accused who has stated the modus operandi as to how occurrence took place with the association of the petitioner. Learned counsel has further submitted that there is nothing against the petitioner except the confessional statement. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has got one more criminal case related to Arms Act other than the present case. The petitioner is in custody since 23.9.2022. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Sasaram in connection with Sanjhauli P.S. Case No.
Patna High Court CR. MISC. No.16921 of 2023(2) dt.11-05-2023 3/3 169 of 2022.
The application stands allowed.
